Jack McIntosh's Flag Has Been Flying For Two Years
If the story below was from New York, or California
or maybe Chicago, you might think that's awful, but just the way those
crazy democrat states are. However, this story is from right here in
Loudon County, in Lenoir City in the 5th district in the Harrison Woods
neighborhood.
For two years now, with no problems, 79 year old veteran, Jack McIntosh, has been proudly flying his American flag on the 15' flag pole in his front yard. On May 18th, Mr. McIntosh received a letter from the Harrison Woods property management company telling him he had to take down his flag pole. In fact, he has 30 days to take it down or be fined and have his HOA privileges revoked. If the home owners association had an issue with the addition of a flag pole to one's property, that should have been stated so in the covenants before hand.
Fortunately for Mr. McIntosh and many others, HOA's/POA's/ACC's CAN NOT prohibit a property owner from flying the American flag how they want.
I know when someone buys property in a restricted development, they agree to abide by the covenants of that development, but oddly enough, the Harrison Woods HOA covenants have no mention, of any kind, of prohibiting flag poles on homeowner's property. So apparently, the HOA just made a unilateral decision to force Mr. McIntosh to remove his flag pole in violation of both state and federal law. The very idea, that right here in Loudon County, we would have any association or organization of any kind that would attempt to prohibit or dictate how someone may fly the American flag is just unacceptable. As a resident of the fifth district and a constituent of mine, I fully support Mr. McIntosh's right to fly his flag how he wants and will do everything I can as a county commissioner to see that his rights are not infringed on. Thank you Mr. McIntosh for your service to our country.
My Letter To The HOA

I am in receipt of
a copy of your letter to Mr. Jack McIntosh, 563
Yellowstone Lane Lenoir City, demanding that he remove
his flag pole, thus his American Flag from his
property.
This demand fly's in the face of federal and state laws that prohibit an organization, such as you represent, from prohibiting a property owner from flying the American Flag on a flag pole. Additionally, the Harrison Woods covenants make no mention of any prohibition to fly the American Flag in any form. If there were already regulations in your covenants detailing how the flag could be flown, it would be a different matter. Your letter seems to take great liberty in interpreting the covenants to claim a flag pole with flag are "being an improvement or alteration to the property". Even if this were so, there's still the matter of state and federal laws that protect Mr. McIntosh's rights, Public Law No: 109-243 (07/24/2006) Freedom to Display the American Flag Act of 2005 and Tennessee Code Annotated 66-27-602 Display Of The American Flag By Property Owners. As a resident of the 5th District of Loudon County and one of my constituents, I will support Mr. McIntosh's right to continue to proudly fly his American Flag as he has for that last two years. I would respectfully request you and whoever are the members of the board reconsider the decision to force the removal of the flag pole in light of the protective laws and in the name of common since and patriotism.
