New Venue 2
Last week, I did a report on the possibility of a
new venue locating
on River Road in Loudon. I mentioned that there may have been a Non
Disclosure Agreement, NDA, signed by at least some city officials. Well,
there was an NDA and some officials did in fact sign it. It is very
questionable if elected officials are legally allowed to or can even
agree to or sign NDA's. A copy of the NDA can be acquired by a records
request from the City of Loudon.
It's well known that under the Tennessee Sunshine Law, any documents, of any kind that are government related, are public records with a few narrow exceptions. Also curious to this issue is the fact that a Loudon City Planning Commission member, Clayton Pangle, who is also an attorney, presented the proposal to the Loudon City Planning Commission. I spoke with Mr. Pangle last week and he also informed me that he did, in fact, have a financial stake in the project but that he did not vote on the matter as a member of the commission. The vote was unanimous to approve the rezone request. Some members of the River Road community have raised concerns about the possibility of rezoning the property from residential to Small Planned Development District, SPDD and what precedent that might set for the entire community. Also, many activities allowed in a SPDD might not be suitable for the area. The rezone request will be on the Loudon City council meeting agenda tonight, 10/28, for a second and final reading. It was already approved on the first reading last month by the council. |
