Man uses newborn as law enforcement deterrent

A homeless man faces criminal trespassing charges after reportedly entering a home and holding a newborn hostage.

On Thursday, June 27, Officer Will Jenkins with the Loudon City Police Department responded to a local residence regarding a homeless man — identified as 41-year-old Darryl Carter — being on the scene and reportedly threatening a child.

According to the report, dispatch also advised the police officer that the suspect is known to carry a gun and reportedly has a restraining order against him. When Jenkins arrived at the home, he made contact with Carter in a bedroom at the residence. Carter reportedly was sitting in bed holding a newborn baby, along with 4-year-old twins.

Dispatch advised Officer Jenkins that Carter was trespassed from Loudon Housing Authority property. The policeman gave Carter multiple lawful orders to put the baby down and step outside; however, despite Jenkins’ efforts, the suspect continued to refuse the officer’s directives multiple times.

According to the arrest reports, Carter used the baby as a means to prevent law enforcement from placing him under arrest and adversely affected the child’s welfare by placing the baby in a tense and dangerous situation.

After a few moments of negotiation, the suspect put the baby down and was taken into custody.

Officer Jenkins then transported the suspect to the Loudon County Jail. And the police officer reportedly filed a child abuse referral on the incident.

Carter was charged with criminal trespassing and was held on $3,000 bond.

FUGITIVE APPREHENDED AFTER SPEEDING

A Lenoir City man, who reportedly had multiple warrants out for his arrest, was apprehended after speeding on a local highway.

On Thursday, June 27, Officer George T. Eldridge with the Lenoir City Police Department was traveling north on Highway 321 when he noticed a Chevy Malibu traveling at a high rate of speed.

Eldridge began pacing the vehicle, which reportedly got up to speeds of 60 mph in a 40 mph zone. A traffic stop was then conducted and contact was made with the driver — 22-year-old Jose Francisco Rivera-Herrera of Lenoir City.

According to the report, Rivera-Herrera was unable to provide a driver’s license or insurance on the vehicle. He also advised officers that he had a small amount of marijuana in the vehicle.

Dispatch then advised officers that Rivera-Herrera had a “full extradition warrant” out of Georgia for a failure to appear for possession of meth (felony) as well as a local warrant — but the hard copy wasn’t located.

Dispatch sent a National Crime Information Center hit to Georgia, which did confirm that they would pick the suspect up. Rivera-Herrera was then placed in custody and transported to the Loudon County Jail.

He was charged as a fugitive of justice and was held without bond.
