News Herald Arrest Report

Loudon man arrested for 911 misuse

A Loudon man is facing a charge for misuse of the 911 emergency system after law enforcement responded to his residence multiple times.

Dispatched Sept. 19 to Corinth Church Road in reference to an unwanted guest, Loudon County Sheriff’s Office Deputy Kevin Kirkland met Richard Lee Brotherton, 43, who said someone was on his back porch trying to get into his home.

Kirkland noted in his report that Brotherton was not making sense regarding who was at his house, could not give a description and appeared to be under the influence of drugs. Kirkland determined no one was at the house.

The deputy was called back later when Brotherton said there was a man and woman trying to steal the radio out of his vehicle, and that he could see them in the front and the back porch. When Kirkland arrived, Brotherton was inside his vehicle. He said the two ran behind the house, but Kirkland could not find anyone. Brotherton said he was not on drugs except for anti-depressants, and that he had been up all night and day and needed sleep.

Kirkland left the scene after telling Brotherton he would be arrested if he misused the 911 system.

“Brotherton stated that he understood and he would not call again unless it was an absolute emergency,” Kirkland wrote in a report. “... Brotherton called 911 again and stated that there was someone in his mother’s bedroom having sex. Upon my arrival, Mr. Brotherton met me outside and stated they were in the bedroom, or on the roof, or in the basement.”

No one was in the residence.

Brotherton was charged with misuse of the 911 emergency system and released on $1,000 bond.

Argument about the Lord

While responding to an incident on Corinth Road, LCSO Deputy Austin Parton was told by dispatch that Happy Jaziz Lemarr, 24, admitted hitting a woman.

Parton spoke with Lemarr and told him he had heard through dispatch about the incident. Lemarr claimed “it was my word against his,” and Parton could smell an alcoholic beverage. Lemarr would not walk with Parton because “he was scared.” He was eventually detained after another deputy arrived at the scene. Parton then spoke with a family member of Evonlee Star Harris, 22.

“She stated that Mr. Lemarr and Ms. Harris were arguing about the Lord when Mr. Lemarr smacked Ms. Harris,” Parton wrote in a report. “Ms. Harris then slapped Mr. Lemarr and he then called 911. I then spoke to Ms. Harris who stated that they were both drinking and that Mr. Lemarr hit her. She then slapped him back. I asked why she hit him and did not walk away and she stated because she was mad.”

Harris was also placed into custody.

During a search, Lemarr became upset and spat on Parton. He also refused to face the vehicle and kicked the patrol car door, causing a dent.
