Dear General Skrmetti:

Earlier this summer, six members of the General Assembly traveled to our Southern U.S. Border and saw firsthand how the current Administration is failing in their Constitutional obligation to secure our southern national border. This failure has now led to an approximated 6 million illegal aliens entering our country. In any other time, this number of foreign nationals illegally entering our country would have been considered a hostile invasion and an act of war.

Allowing this ‘invasion’ to continue, if not criminal, is a violation of the Oath of Office taken by each member of the Administration. It endangers all the lawful inhabitants of this country by allowing a point of entry for gangs and other criminal enterprises, as well as for terrorist organizations. An existential threat to our citizens results from these criminal and terrorist organizations. This is furthered by the electoral risk in national elections, resultant from some states not requiring identification to vote. Local budgets are impacted due to the cost of providing medical treatment and educational resources, as well as for incarcerating those who have committed crimes in our communities.

We, as members of the General Assembly, must do all that we can to protect the citizens of Tennessee from the effects of the federal government’s inability or unwillingness to secure our border with Mexico. We are convinced that civil suits and/or criminal charges should be considered. Holding those who have violated their Oath of Office accountable and seeking financial restitution should be evaluated. Tennesseans must not be forced to bear these costs. Therefore, we request that your office investigate whether there is any on-going litigation against the federal government for its failure to carry out its Constitutional obligations delineated in Article IV, Section 4 of the United States Constitution. If there is such litigation and Tennessee is not a party in that action, we would ask that steps be taken for Tennessee to join said action. If you find that no such litigation has been filed to address the concerns above, we urge you to initiate such an action on behalf of Tennessee. We would also request that each member of the General Assembly signing this letter be updated on your findings and the progress of any litigation.
