Illegal Annexation 9

At tonight's county commission meeting, 2/6 at the annex, commissioners will vote on taking legal action to invalidate two illegal annexations passed by Lenoir City. One of the illegal annexations took place last November, WNW, and the other one took place in May 2020, Belle West Pointe. Both annexations were outside the city's Urban Growth Boundary, UGB, which makes them illegal under state law.

Newly elected 2nd district county commissioner, William Jenkins, is running point for Lenoir City mayor, Tony Aikens and company passing out documents he claims shows reasons the county can't sue the city, and in the process, walking a fine line on the state law that prohibits one elected official from lobbying another elected official.

Jenkins' documents are about the process for a property owner to challenge a legal annexation. The county isn't challenging a legal annexation. The county is challenging an illegal annexation. There are no laws that allow a city to annex property outside their UGB.

Aside from both annexations being illegal under state law, there are many procedural issues with both annexations. Everything from missing documents, failed votes and very questionable signatures that, on their own, could render the annexations void.

I have no idea how the vote to proceed with legal action against the city will go, but everybody knows if these illegal annexations by Aikens and the city are allowed to stand, there's nowhere in the upper end of the county that will be safe from the city's insane zoning regulations and mass urban sprawl.

There's much at stake for all of us.
