While the wheels of justice may move slow, maybe the
case against mud man, Rodney Murphy, is getting closer to resolution. Last week, the county/Greenback, filed a motion for summary judgment and a permanent injunctive relief against Murphy and company. The case could be heard as early as October. What this means is, our side has provided the judge with all the facts of the case and are asking the judge to stop the quarry work permanently. And given the facts of the case, it's hard to imagine the judge, Chancellor Tom McFarland, wouldn't just do that. There's no question that the mud man is in violation of county/Greenback zoning regulations. If the judge, for some reason, does not grant the summary judgment, the full trial will be held December 6th. A little background. Blount County bobcat operator, Rodney Murphy, after finding a financial backer, bought what's known as the Hutton Farm in the heart of Greenback with the intent of opening a quarry. Murphy knew full well the property was not zoned for a quarry. But he moved ahead any way. He was served with a cease and desist notice back in March which, of course, he ignored. In April, the county/Greenback filed a lawsuit against the mud man, he ignored that and keeps right on digging. Murphy has shown he has no regard for anyone or anyone's property since he began his destruction of the Hutton Farm. Hopefully, in October, the mud man's reign of terror on his neighbors and the community at large will come to an end. Unfortunately, Murphy is not unique. Loudon County has about a half dozen people like Murphy who think they are above all the rules and laws and can do anything they want, run over anyone they want, without regard. Guess we'll find out soon. |
