News Herald Arrest Report

Greenback man charged with trespassing

A local Greenback man was recently arrested after reportedly attacking vehicles at a Loudon County Golf Club.

On Tuesday, September 24, Deputy Dalton Harrison with the Loudon County Sheriff’s Office was dispatched to the area of Wind River Golf Club, a private gated community, in reference to a male who reportedly wasn’t supposed to be there walking inside the gate and screaming and yelling at vehicles.

Dispatch advised the male was trying to push on the gate as it closed while he was leaving the area. Deputy Freeman made contact with the complainant at the entrance to the neighborhood in the guard shack while Deputy Harrison stayed in the area of Highway 321 attempting to locate the suspect.

Harrison made contact with the subject, later identified as 38-yearold Cody Hamilton of Greenback, on Highway 321 at Antioch Church Road. As Harrison attempted to stop the suspect to conduct an investigation Hamilton reportedly continued to walk down 321 and ignoring orders to stop.

According to the report obtained by The News-Herald, Deputy Harrison advised Hamilton he was being detained but he continued to ignore commands and walk away. Harrison then stopped Hamilton and placed him on the hood of the deputy’s patrol car — at which point the suspect continued to resist and was placed on the ground.

Once Deputy Harrison was able to secure the suspect’s hands behind his back, he was placed in custody without further incident.

Deputy Freeman arrived and secured the suspect in his patrol vehicle. Deputy Harrison left the area and arrived at Wind River to speak to the complainant who is the security guard for Wind River.

The security guard stated residents were calling the guard stating a male was walking in the neighborhood cussing at vehicles as they drove by. The manager of the community called the guard shack as well and stated at one point Hamilton threw a cone at her vehicle.

The security guard made contact with Hamilton as he was walking toward the exit gate. The suspect was asked if he lived in the community to which he stated “no.”

The security guard stated that, at this point, Hamilton continued to cuss at him and made a threat to harm him. “Based on the facts above,” according to the police report, Hamilton was placed in custody for resisting arrest and criminal trespass.

Hamilton was charged with criminal trespassing, resisting arrest and was held on $3,000 bond.

LOUDON WOMAN CHARGED WITH DUI

On Thursday, September 26, Deputy Ryne Miller was notified of a possible drunk driver traveling on Highway 444.

A caller reached out to Dispatch advising that he was behind a black BMW driving recklessly. Deputy Dakota Ezell observed a vehicle matching the description given by the complainant and turned around to observe the vehicle.

The vehicle pulled into the Tellico Village Community Church and Deputy Ezell followed to check the welfare of the driver due to the call received.

The driver was identified as 54-year-old Kathy Lane of Loudon. Lane stopped her vehicle and exited.

Deputy Ezell advised her to get back in her car and upon approaching the vehicle, he reportedly smelled the strong odor of an alcoholic beverage. He also saw multiple empty cans of beer in the front passenger seat.

Upon Deputy Miller’s arrival to the scene, he saw the suspect walking around and Deputies Ezell and Watson insisting she stay still.

On Miller’s initial approach, he described Lane’s eyes as watery and bloodshot. The deputies then attempted to conduct Standardized Field Sobriety Tests (SFSTs) on Lane. According to the report, after completing the Horizontal Gaze Nystagmus Test, which Lane performed poorly, she refused to do the other two SFSTs due to physical limitations.

Deputy Watson then conducted Advanced Roadside Impaired Driving Enforcement (ARIDE) Tests. After the test was complete, deputies concluded that Lane performed poorly on all tests.

Deputy Miller then placed Lane under arrest for Driving Under the Influence. After completing an inventory of the vehicle, it was found that there was an open 12-pack of Miller Lite beer in the passenger area.

According to the arrest report, there were multiple empty cans and the remaining three cans in the case were cold to the touch. Lane’s vehicle was towed and Implied Consent was read to Lane and she submitted to blood testing. She was transported to Fort Loudon Medical Center, where blood was drawn and then transported to the Loudon County Jail without further incident.

Lane was charged with driving under the influence, open container and was released on $1,500 bond.
