Lenoir City Election Voided

Yesterday, was the hearing on the remanded case of McNabb v Harrison in Loudon County Chancery Court. You will recall, the Tennessee Supreme Court ruled in favor of current Lenoir City council member and former Lenoir City judge, Robin McNabb in her challenge to the qualifications of judge Greg Harrison, to hold the judgeship in Lenoir City.

In their ruling for Ms. McNabb, they also remanded the case back the judge Tom McFarland for final disposition. McFarland ruled the 2022 city judge election void due to the election winner, Greg Harrison, being disqualified to run for the seat due to the fact he did not live within the city limits as required by the state constitution. 

The judge also awarded certain court costs to be paid by Harrison to Ms McNabb. The judge may also award other legal fees to Ms. McNabb to be paid by Harrison. Harrison objected to having to pay those costs to McNabb.

Last year, at Lenoir City mayor Tony Aikens recommendation, Aikens asked the city council to pay Mr. Harrison's legal fees of  $45,700.00, the council voted to pay attorney, T Scott Jones fee. Ms. McNabb who is an attorney, represented herself in all the legal proceedings. Mr. Harrison, who is also an attorney himself, opted to hire Jones to represent him.

This entire issue was caused because Aikens thought he could just get by with violating the laws and state constitution and would likely have gotten by with it but for Ms McNabb's unwillingness to give up doing what was right.

Aikens sorely underestimated McNabb's willingness to go the distance. Will he do it again?
