Commissioner Hurley Update
With the March 6th deadline for Commissioner Hurley
to either move back into the 2nd district or resign approaching quickly,
apparently Ms. Hurley has yet to move back into the 2nd district, where
she was elected. However, according to her attorney, T. Scott Jones, Ms.
Hurley can vote in the upcoming election, in his opinion. In his December opinion, District Attorney, Russell Johnson, among other things, reported that Ms. Hurley could not vote in the March election due to her moving without changing her registered address with the election commission. Hurley's attorney disagrees with DA Johnson citing 1916 case law. When every Loudon County voter goes to vote, we must sign twice and initial a ballot application that essentially swears that the address shown on our voter registration is our right and current address under penalty of 2-12 years in prison and up to a $5,000 fine. So if Ms. Hurley's voter registration states that her current address is the 5th Ave address but she actually lives at the Yellowstone address, would signing her ballot application be an act of voter fraud? I have no idea. Commissioner Hurley is still under the March 6th deadline to move back into the 2nd district, where she was elected, resign or face an ouster suit by DA Johnson. |
