From District Attorney, Russell Johnson:

The case involving Devin McGuire (31 YOM), arising out of an incident on December 27, 2020 where he and a female companion co-defendant allegedly ran from law enforcement in a vehicle northbound on Hwy 11 while McGuire is alleged to have continued to shoot an assault style rifle at officers pursuing the two co-defendants in four separate vehicles, was bound over to the Loudon County Grand Jury after a preliminary hearing on Wednesday at which hearing Loudon General Sessions Court Judge Rex Dale determined that prosecutors from District Attorney General Russell Johnson's Office proved probable cause on each of the multiple counts or charges, including four counts of attempted first-degree murder for each of the four officers involved in the chase.

Two charges of theft and aggravated burglary were dismissed by the State before the hearing due to the unavailability of the witness/victim. These charges were the result of McGuire allegedly fleeing the scene after the vehicle in which he and his co-defendant were traveling was stopped by officers and McGuire was later found in the victim's garage. These charges can be brought up again before the grand jury.

The hearing took place in the smaller of two courtrooms at the Loudon County Justice Center and testimony from the officers and LCSO Detective Charles Cosner was deemed sufficient by Judge Dale to move the case forward. The next meeting of the Loudon County Grand Jury, at which time District Attorney General Johnson states that the case will be presented, will occur on April 12th & 13th. (Grand juries meet only three times each year in Loudon County during April, August and December).

McGuire remains in custody in the Loudon County Jail on a $490,000 bond. Prosecutors have filed a 'bond source motion' so if McGuire attempts to make bond the State can delve into the source of funds being used by whomever tries to make his bond. The co-defendant, Asia Gillispie (38 YOF) reached an agreement with prosecutors to waive her case to the Loudon County Grand Jury. She also remains in custody.

Assistant District Attorney Bob Edwards handled the hearing for the State. McGuire was represented by Attorney Stephen McGrath.

The officers involved in this case and who were part of the pursuit are: Lenoir City PD Officer Carlos Espinoza, LCSO Deputy Luke Hawkins, LCSO Deputy Cole Rodgers and LCSO Deputy Skyler Mills.

ANY PERSON CHARGED WITH A CRIME IS PRESUMED INNOCENT UNTIL PROVEN GUILTY BY A COURT OF LAW AFTER A JURY TRIAL GUILTY VERDICT AND CONVICTION OR A CONVICTION BASED UPON A GUILTY PLEA. ANYONE CHARGED WITH A CRIME WHO IS UNABLE TO AFFORD AN ATTORNEY WILL BE PROVIDED ONE A TAXPAYERS EXPENSE.
