Subpoena Update

Last week, I reported about being subpoenaed by Ken Brewster in his divorce case. I also told you how I had tried to reach his attorney to tell them I couldn't make the date and time they wanted. I never heard a word back from them.

Tuesday, 10/3, I submitted a letter to the court handling the divorce case to explain my scheduling conflict and later that day, I received an email acknowledging my scheduling conflict with an agreement to reschedule. Not sure why it took so long for them to respond. I haven't yet heard anything from the lawyer about a rescheduling date.

I did agree with their terms. I'm actually looking forward to my deposition just to see what I could possibly bring to the discussion since I don't really even know either party in the divorce case.

To The Honorable Judge Pemberton,

On Tuesday September 26, I was served with a subpoena for deposition in the divorce case of Jennifer Carol Brewster v Kenneth Nathaniel Brewster, case 2021-CV-112. The deposition was scheduled for October 4, 9:00 am at a location in Loudon.

I will not be able to attend the deposition due to a previously scheduled medical appointment on the same day and time.

On September 26, I contacted the law office of Kenneth Nathaniel Brewster, who issued the subpoena, to let them know of the conflict. I was connected to the lawyer’s voicemail where I left a message of the time conflict. I did not receive a return call. On September 27, I contacted the same law office by email to inform them of the time conflict, I never received a reply. On September 28, I sent the law firm an overnight, certified, signature required letter by USPS  informing them of the time conflict. The letter was received in their office and signed for on September 29 10:00 am. I still haven’t heard anything from their office.

Please allow this letter to stand as an objection of the subpoena due to a medical appointment conflict. The subpoena states that I have 21 days to file any objections to the subpoena yet I have only 8 days from the time I received the subpoena until the date I was to be deposed.

In my correspondence with the law office, I have agreed to be deposed at most any other day or time.
